The case involves a legal dispute between Miejski Mlodsiezowy Klub Sportowy (MMKS) Concordia Elblag, a Polish football club, and Jesús Vicente de los Galanes, a Spanish football coach, over the termination of an employment contract and associated financial claims. The parties entered into a contract on 1 February 2014, valid until 31 December 2016, with the coach receiving a monthly net salary of PLN 1,500. The club terminated the contract on 30 May 2014, citing the team's relegation to a lower league as justification under the contract's terms. The coach subsequently filed a claim with FIFA’s Players’ Status Committee (PSC) on 6 October 2014, seeking unpaid salaries, bonuses, travel expenses, and damages. The PSC partially accepted the claim in its 11 October 2016 decision, ordering the club to pay PLN 16,955.92 in outstanding remuneration and PLN 3,500 as compensation, while rejecting other claims. The club contested this decision, alleging the coach had submitted forged contracts and initiated criminal proceedings in Poland. The PSC later clarified that the club had terminated the contract without just cause and failed to prove salary payments for March to May 2014. The club appealed to the Court of Arbitration for Sport (CAS) on 13 June 2017, requesting a three-member panel. The CAS proceedings focused on the validity of the termination and the club's financial obligations. The Sole Arbitrator, Bernhard Welten, determined the February 2014 contract was valid and enforceable, dismissing the coach's claims due to his lack of participation in the proceedings. The Arbitrator ruled the termination was justified under the contract's terms, as the team's relegation was mathematically certain. The club was ordered to pay PLN 2,788.29 in outstanding travel costs, as stipulated in the contract, but no compensation was awarded for the termination. The CAS partially upheld the appeal, amending the PSC's decision to reflect the payment of travel costs and canceling the previously awarded compensation. The decision reinforced the enforceability of contractual terms and the importance of procedural compliance in sports disputes. The award was issued on 12 June 2018.
